SRINAGAR, OCTOBER 09 (STC)
: The Supreme Court will hear petitions seeking the restoration of Jammu & Kashmir’s statehood on Friday, reveals a report.
The petitions are listed at serial number 17 before the Court of Chief Justice of India (CJI). “The case is listed for hearing on October 10 before a bench headed by the Chief Justice of India,” advocate Soayib Qureshi told media.
According to Qureshi, Union of India has not filed any response on the matter yet.
It is worth mentioning that on August 14, during the hearing of a petition for restoring statehood to Jammu and Kashmir, the Supreme Court had stated that the real situation on the ground must be considered and that incidents such as the Pahalgam attack cannot be overlooked.
The petitioners have argued that the continued delay in restoring statehood violates the principle of federalism, which is part of the basic structure of the Constitution.
They have also submitted that no steps have been taken to lay out a clear timeline or implement the Supreme Court’s December 2023 directive that ‘restoration of statehood shall take place at the earliest and as soon as possible’.
