Teacher found involved in POCSO case sacked, govt disqualifies him from future government jobs

SRINAGAR, SEPTEMBER 21 (STC): The Jammu and Kashmir government has sacked a government school teacher facing a POCSO and BNS case, invoking Article 311(2)(b) of the Constitution and permanently disqualifying him from future government employment.
Khalid Hussain, Teacher Grade-II at Government Middle School Bumalpora, Gurinalla in Kishtwar district, was dismissed with immediate effect under Government Order No. 388-JK (Edu) of 2026 issued by the School Education Department on Monday.
Hussain was already under suspension and is in judicial custody in connection with FIR No. 34/2026 registered at Police Station Chatroo under Sections 61(2), 65(1), 90, 91 and 92 of the Bharatiya Nyaya Sanhita (BNS), 2023, and Sections 4, 6, 8, 10 and 17 of the Protection of Children from Sexual Offences (POCSO) Act.
The government said the material on record and the circumstances of the case warranted the major penalty of dismissal from service.
It said a regular departmental inquiry was “not reasonably practicable” and invoked Article 311(2)(b) to dispense with such an inquiry.
The order said the case fell in the category of “rarest of the rare cases” and that allowing the teacher to continue in government service would be detrimental to the interests of the government and erode public trust in government institutions.
The dismissal, ordered under the relevant provisions of the J&K Civil Services (Classification, Control and Appeal) Rules, 1956, ordinarily disqualifies Hussain from future government employment.
The School Education Department, in a separate statement, said the action reflected the government’s commitment to protecting children in educational institutions and ensuring strict accountability of school staff.
The department said the criminal investigation and trial in the matter would continue before the competent authorities in accordance with law.
The administrative action does not constitute a finding of guilt in the pending criminal case, the outcome of which will be determined through the judicial process.
